Our commercial litigators are dedicated advocates, who have extensive experience in litigating matters with varying degrees of size and complexity.
Our litigation clients, which include international and national companies, small businesses and individuals, have entrusted us to represent them in state and federal courts, arbitrations, and administrative proceedings. We value that trust and ensure that all matters receive the appropriate resources and attention, while seeking the most timely and cost-effective resolutions for our clients. Our responsiveness and attention to detail have resulted in loyal, longstanding relationships with our clients, who rely on us to handle everything from basic contract disputes to complex litigation.
The following are some examples of the work our litigation team has successfully handled:
- Article 78 proceedings in New York State Supreme Court, to overturn improper zoning determinations rendered by municipalities throughout the region.
- Challenges in state and federal courts against various municipal ordinances and local laws enacted to prohibit or substantially limit development.
- Reversals of municipal denials for wireless communication facilities pursuant to federal statutes and regulatory rulings, including the Telecommunications Act of 1996.
- Invalidated a local law by demonstrating the municipality failed to conduct the proper “hard look” mandated by SEQRA.
- Overturned a local law that attempted to prohibit 24-hour operations.
- Negotiated a multimillion-dollar settlement with a building owner to relocate client’s equipment, recovered cost of new equipment, obtained a substantial reduction in monthly rent and secured additional favorable lease terms.
- Obtained a temporary restraining order to stop a real estate developer from converting a commercial building into a $400 million residential condominium.
- Obtained a temporary restraining order and preliminary injunction that prevented a landlord from collecting over $5 million in allegedly past-due common area maintenance charges and from terminating the lease of our client’s largest facility in North America.
